It is a clause found typically in employment contracts
wherein the independent contractor or employee agrees not to compete with the
employer for a period of time after termination of the contract within a
specific geographic area.
Are non-compete clauses enforceable against physicians?
Non-compete clauses usually are enforced in Missouri,
provided they are reasonable with respect to the geographic area covered and
length of time of the non-compete restriction. Therefore, before the physician
signs any non-compete agreement, he or she should consider it carefully and
understand that it likely will be enforceable.
