Physician's Guide to Medicine - Good Samaritan Law
Under what circumstances is a physician not liable for an alleged act of
malpractice which occurred while rendering emergency care?
(1) When a physician gratuitously and in good faith renders emergency care or
assistance at the scene of an emergency or accident, provided that any act or
omission is not grossly negligent, willful or wanton; or
(2) When a physician gratuitously and in good faith renders emergency care or
assistance to any minor injured in an accident, competitive sports, or other
emergency at the scene of an accident, without consent of the minorīs parent(s)
or guardian, provided that any act or omission is not grossly negligent, willful
or wanton.
